Definitions

We are TraqNext, doing business as Software Technologies ("Company", "we", "us", "our"), a company registered in Pakistan at Suite 8, 1st Floor, Al-Hafeez suites, 69/B-2, Gulberg 3, Punjab, Lahore.

We operate the website http://www.traqnext.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Services are intended for users who are at least 18 years old or above. People under the age of 18 are not permitted to register for the Services.

The following terms and conditions (the “Agreement”) govern all use of the TraqNext.com website and the services available on or at the Site (taken together with the Site, the “Service”). The Service is a real-time time tracking service that analyzes productivity. The Service is owned and operated by TraqNext.

Billing cycle refers to the period for which billing is done at one time.

Customer Data means the customer related information that you collect through the Subscription Services. Additional information that may be collated by us and provided for your use will not be included in the scope of Customer Data.

Consulting Services means the services provided by us, which may include training services, integration and consulting services. Details of the Consulting Services will be subject to the terms of service set out in your Order form.

By using the TraqNext desktop app, web application or website (“Service”), you agree to be bound by the following terms and conditions (“Terms of Service”).

1. OUR SERVICES

TraqNext provides time tracking and employee monitoring solutions. The services include, but are not limited to, tracking work hours, monitoring employee productivity, and providing analytical insights into workforce operations. The Company reserves the right to modify or discontinue any service or feature without prior notice.

2. User Responsibilities

By using TraqNext, you agree to the following things:

  • Provide accurate information during the registration.
  • Secure the confidentiality of your account credentials and be responsible for all activities under your account.
  • Use the services in compliance with all applicable local, state, national, and international laws and regulations.
  • Avoid any activity that interferes with the services provided by TraqNext.

3. Purchase and Payment

We accept the following payment methods:

  • MasterCard
  • American Express
  • Visa
TraqNext allows up to three users to use all features without any charges.

Subscription Fees:

The Service is billed in advance on a monthly or annual basis and is non-refundable. TraqNext is available under various subscription plans. Fees are specified in the Service and are payable in advance, and exclusive of taxes.

Goods and Services Tax (GST):

Applicable GST is charged based on the services provided and the local tax regulations. You are responsible for payment of all such taxes.

4. Updates and New Releases

TraqNext will keep you informed of any updates and new releases of the application that are better than the previous version of TraqNext. These updates and releases may occur automatically and might cause a temporary disruption in service. You agree that the Company is neither liable for any such disruption nor obligated to provide any particular updates or support.

5. Security

Customers shall be responsible for maintaining the security of their own account and password. You are also responsible for any account that you have access to. You agree to notify us immediately of any unauthorized use of your account. TraqNext cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

TraqNext will maintain safeguards to prevent access to or access to objectionable content in accordance with company standards.

6. Warranties

TraqNext does not warrant the Service will meet your specific requirements. No warranty is given as to the results obtained from the use of the service and the accuracy of any information obtained through the service.

Results that may be obtained from the use of the Service will be accurate or reliable. The quality of any products, services, information or other material purchased or obtained by you through the Service will meet your expectations. Also, any errors in the Service will be corrected.

7. Confidentiality

Both parties agree to treat all confidential information as confidential and to not disclose such information to any third party without prior written consent unless required by law.

You will take all steps to ensure that your employees and agents and any contractors engaged for the purposes of these terms do not disclose TraqNext confidential information.

The Service uses Google Analytics to collect information to improve the products and features that users use most often and to help solve problems.

8. Limitation of Liability

In no event will the Company be liable for any indirect, punitive, special, incidental, or consequential damages, however, they arise, whether for breach of contract, tort, or otherwise, even if the Company has been advised of the possibility of such damages.

We disclaim any and all liability for the acts, omissions, and conduct of any third parties related to your use of TraqNext and any linked sites and services.

If, notwithstanding the other provisions of the Terms, we are found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Website or any of our Services, our liability shall not exceed what you paid us for the Services in the previous month. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

9. Indemnification

You agree to indemnify and hold us blameless from any and all demands, loss, liability, claims or expenses made against us by any third party due to or arising out of or in connection with your use of TraqNext.

10. Intellectual property

You own your content. We do not represent or claim any copyright in the content you provide. We are the owner of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos.

You may not copy, reproduce, modify, resell TraqNext, our Services, or our content on TraqNext without our permission.

11. Termination and Suspension

TraqNext may terminate or suspend your access to the services without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions. In the event of cancellation or termination, we retain the right to retain or delete data provided to us by you at our sole discretion.

12. Changes to Terms and Conditions

TraqNext reserves the right to revise these Terms at any time. By continuing to access or use our services after those revisions become effective, you remain subject to the revised terms.

It is your responsibility to check the Terms periodically for changes. Your continued use of TraqNext following the posting of changes will mean that you accept and agree to the changes.

13. General

To use TraqNext, you must comply with the following conditions:

  • At least eighteen (18) years of age.
  • Complete the registration process and provide accurate information.
  • You are responsible for all content you provide and your activities on TraqNext.
  • You will use TraqNext in compliance with all applicable laws, rules, and regulations.
  • You will not use TraqNext to solicit the performance of any activity which infringes our rights or the rights of others.
  • You understand that TraqNext uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
  • You will not use TraqNext to upload, transmit, or otherwise distribute any objectionable content.
  • We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other Service customers.
